1. Real Vision: The Real Vision Season 2 NFT Bonus Drawing (the “Drawing”) is sponsored by Real Vision Group SEZC, a Cayman Islands special economic zone company having a principal place of business at Floor 3, Strathvale House, 90 North Church Street, George Town, Grand Cayman KY1 1003 Cayman Islands Cayman Islands (“Real Vision”).
2. Eligibility. To be eligible for the Drawing, you must: (i) register for the Drawing as described below, and (ii) be the digital-wallet-verified owner of the winning Real Vision Season 2 NFT at the time of the drawing. Real Vision will randomly select ten (10) Season 2 NFT winners, and will notify such winners via the contact information submitted via registration.
3. Prizes. Real Vision will use five percent (5%) of the proceeds derived by Real Vision from the sale of the Season 2 NFTs during the first week of minting to purchase call option contracts for Ethereum. The terms of the ETH option contracts will be determined by Real Vision in its sole discretion and will be communicated on www.realvision.com/collective/bonus. Upon the expiration of the call options, if they are “in the money,” they will be converted to Ethereum tokens (ETH), which ETH prize pool (the “Prize”) will then be distributed to the winners in the following proportions:
A. Runner Up Prizes: Nine (9) winners will divide fifty percent (50%) of the Prize (i.e., approx.. 5.55% of the Prize Pool to each runner up winner).
B. Grand Prize: One (1) grand prize winner will be awarded the balance of Prize (i.e., the remaining 50%).
If the ETH option contracts expire out of the money, there will be no Prize to divide.
4. To Enter: To participate in the Drawing, eligible entrants must complete their entry in accordance with the instructions found on the entry here: www.realvision.com/collective/bonus
5. Drawing Eligibility Period: The registration eligibility window commences at 12:01 AM CST on 1st Sep 2023 and ends at 11:59 PM CST on 29th Dec 2023. Winners will be selected on or before 31st Dec 2023.
6. Residence Eligibility: The Drawing is open only to (i) living individuals who are at least twenty-one (21) years of age or older (or the age of majority in their state or jurisdiction of legal residence, whichever is older); and (ii) who are legal residents of the fifty (50) United States and the District of Columbia where this Drawing is legal. Should an entrant outside of the United States be selected to win a Prize, Real Vision will give good faith consideration to fulfilling such Prize, so long as such fulfillment does not violate any laws of the jurisdiction in which such entrant lives. THE DRAWING IS OTHERWISE VOID IN PUERTO RICO AND WHERE PROHIBITED OR RESTRICTED BY LAW.
The following are not eligible: Employees, officers and directors of Real Vision or their respective parents, subsidiaries, members, affiliates, advertising, promotion and web design agencies, and their respective affiliates, assigns or representatives; and any other individuals or entities associated with the development, administration, promotion, advertising, execution of, or supply to this Drawing; and family members (including spouses, parents, children, and siblings and their spouses) or persons living in the same household as such individuals, whether related or not, are not eligible to participate or win. Participation in this Drawing constitutes your agreement to be bound by these Official Rules.
7. NO PURCHASE NECESSARY. NO PURCHASE OF THE SEASON 2 NFT FROM REAL VISION IS NECESSARY TO WIN OR TO ENTER FOR A CHANCE TO WIN, SUBJECT TO THE ELIGIBILITY REQUIREMENTS ABOVE. HOLDERS OF THE SEASON 2 NFT FROM A SECONDARY MARKET MAY ENTER SO LONG AS DEADLINES ARE MET.
8. Random drawings/odds of winning: The odds of winning a Prize depends on the total number of eligible Entries received.
9. Taxes/Minting Costs: All winners shall be solely responsible for all (a) federal, state and/or local taxes, and (b) other fees and expenses not specified herein associated with the receipt and use of any Prize. Entrants are responsible for their own NFT minting/purchasing costs. Prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
10. Winner Notification: Winners will be notified by the e-mail used at registration after completion of the relevant random drawing. If a notification is returned as undeliverable or if a winner cannot be reached, is ineligible, or declines his or her Prize, the Prize will be awarded to another randomly-drawn entry as the winner. Winners are subject to verification, including verification of age. Real Vision is not responsible for any change of email address, mailing address and/or telephone number of participants. P.O. Boxes are not acceptable as mailing addresses. Awarding of a Prize is subject to verification of the winner’s eligibility and full compliance with these Official Rules and all applicable laws such as those known as “KYC” and “AML” laws. As a condition of accepting a Prize, winner must respond to Real Vision’s notification of winning within three (3) business days from the time of notification. Any unclaimed and/or unused portion of the Membership will be forfeited and will not be substituted, nor will there be any refund for any unclaimed and/or unused portion of the Membership.
11. General:
A. Drawing Cancellation: Real Vision reserves the right, in its sole discretion to cancel, terminate or suspend this Drawing, or any portion thereof, should virus, bugs, non-authorized human intervention or other causes beyond the control of Real Vision (including “force majeure” events and insolvency) that would prevent, corrupt or impair the administration, integrity or security of the Drawing (including but not limited to attempts to hack into or otherwise tamper with underlying source code/programming). The Drawing Entities and their respective parent companies, subsidiaries, officers, directors, partners, principals, partnerships, employees or agents are not responsible for hardware, software or telephone failures of any kind, traffic congestion on the Internet, lost network connections, incomplete, garbled or delayed computer transmissions, whether caused by Real Vision, users or by any of the equipment or programming associated with or utilized in the Drawing or by technical or human error that may occur and/or that may damage a user’s system or limit an participant’s ability to participate and/or redeem a Prize in the Drawing. Real Vision reserves the right, in its sole discretion, to disqualify any individual who tampers with the Drawing, violates these Official Rules or otherwise engages in fraudulent or offensive conduct with respect to this Drawing.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANTS TO THE FULLEST EXTENT OF THE LAW.
B. Waiver: Real Vision’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Should any provision of these Official Rules be deemed unenforceable or invalid, the other provisions of these Official Rules shall remain in full force and effect. In the event that this Drawing is challenged by any legal or regulatory authority (including but not limited to any federal or state governmental authority), Real Vision reserves the right to discontinue or modify the Drawing, as applicable, or to disqualify any participants residing in any affected geographic areas, as applicable. In such event, Real Vision shall have no liability to any participants who are disqualified due to such an action.
C. Privacy Policy: Any personal information collected will be subject to the Real Vision’s privacy policy available at https://www.realvision.com/privacy . By entering this Drawing, each participant agrees that Real Vision has the right to contact participant by telephone, email or regular mail as set forth by these Official Rules. In the event of any discrepancy between the privacy policy and these Official Rules, the privacy policy will govern and control. Unless prohibited by law, acceptance of a Prize constitutes permission for Real Vision and its designees to use a Winner’s name, voice, image, likeness, photographs, statements, biographical information and any other personal characteristics, in any and all media now or hereafter known, for any purpose, including without limitation marketing, promotional and/or publicity purposes, without additional compensation to the Prize Winner. Except where prohibited, the Grand Prize Winner must be available for interviews and photos, on dates and times to be decided by Real Vision and allow for release thereof in national and regional television, newspapers, magazines, and Real Vision marketing and promotional materials in all mediums including but not limited to RealVision.com.
D. Release of Liability: Unless prohibited by law, by participating all participants agree that Real Vision, and its parents, subsidiaries and affiliates and its officers, directors, employees, representatives and agents have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any Prize, including, without limitation, to such Prize’s value (is any), quality or fitness for a particular purpose. Some jurisdictions do not allow such releases, so the above may not apply to you. Awarding of the Grand Prize may be conditioned on additional legal requirements, such as eligibility proof.
F. Third Party Terms and Conditions: Prizes may be subject to additional terms, conditions and restrictions of third party providers, including but not limited to access to the Internet, NFT minting services, and option exchanges. You acknowledge and agree that Real Vision will not be responsible for any agreement between you and such third party providers or any content, applications or software provided by such third parties.
G. Request for Winner List and Official Rules: For Official Rules and/or the Winner List, send a self-addressed stamped envelope to: Real Vision, Floor 3, Strathvale House, 90 North Church Street, George Town, Grand Cayman KY1 1003 Cayman Islands Cayman Islands [as specified above], Attn: “REAL VISION SEASON 2 NFT BONUS DRAWING ”. Requests for the Winner List must be submitted within 60 days after the Drawing.
